These terms govern your use of Dream Builds services, tools, and websites operated by Jesse Salas ("we," "us," "our") at dreambuilds.app and related properties.
1. Services
Dream Builds provides AI-powered business tools, website building services, and related digital products for small businesses. Our services include but are not limited to:
- AI receptionist and phone agent services
- AI text response and chat tools
- Website design and development
- Business automation tools
- Monthly subscription management tools
2. AI Disclosure
Our products use artificial intelligence. By using Dream Builds services, you acknowledge:
- AI-generated content, responses, and outputs may contain errors or inaccuracies
- AI tools are assistive — they do not replace professional advice (legal, financial, medical, or otherwise)
- Our AI phone agents identify themselves as AI at the start of every interaction, per California AB 2013, AB 3030, and SB 1120
- You are responsible for reviewing and approving any AI-generated content before publishing or relying on it
3. What We Promise
- We will deliver the services described in your plan or project scope
- Custom websites will be delivered within the timeframe agreed upon (typically 48 hours for standard builds)
- AI tools will function as described, subject to reasonable uptime expectations
- We will clearly disclose when AI is being used in any customer-facing interaction
4. What We Don't Promise
- We do not guarantee specific revenue, lead, or conversion outcomes from our tools
- We do not guarantee 100% uptime — our tools depend on third-party services (Cloudflare, Vapi, Anthropic) that may experience outages
- AI outputs are not guaranteed to be accurate, complete, or appropriate for any particular purpose
- Contract analysis tools (Contract Translator) provide summaries, not legal advice — always consult a licensed attorney
5. Pricing and Payment
Current pricing is listed on individual product pages. We reserve the right to change pricing with 30 days' notice to existing subscribers. Payment is processed through Stripe. All prices are in USD.
6. Refund Policy
See our full Refund Policy. Summary:
- Monthly subscriptions: 30-day money-back guarantee from initial signup
- One-time purchases: 14-day refund window
- Custom website builds: No refund after the site has been launched/deployed
7. Acceptable Use
You agree not to:
- Use our tools for illegal purposes or to harm others
- Misrepresent AI-generated content as human-created when disclosure is required
- Attempt to reverse-engineer, copy, or resell our AI tools
- Use our services to generate spam, phishing content, or deceptive communications
- Overload our systems with automated requests beyond normal usage
8. Intellectual Property
You own the content you create using our tools. We own the tools, designs, and systems that power Dream Builds. The Four Colors Personality System is proprietary to Jesse Salas.
9. Liability Limits
To the maximum extent permitted by law:
- Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim
- We are not liable for indirect, incidental, consequential, or punitive damages
- We are not liable for losses caused by AI output errors, third-party service outages, or your reliance on AI-generated content without independent verification
10. Dispute Resolution
Arbitration: Any disputes arising from these terms will be resolved through binding arbitration administered by JAMS under its Streamlined Arbitration Rules. The arbitration will be conducted in Sacramento County, California.
Small claims exception: Either party may bring qualifying claims in small claims court in Sacramento County.
Governing law: These terms are governed by the laws of the State of California, without regard to conflict of law principles.
Venue: Sacramento County, California.
11. Termination
We may suspend or terminate your access to our services if you violate these terms. You may cancel your subscription at any time. Upon cancellation, you retain access through the end of your current billing period.
12. Changes to These Terms
We may update these terms from time to time. Material changes will be communicated via email or a notice on our website. Continued use after changes constitutes acceptance.
